A Dissolution of Domestic Partnership in California is treated substantially like a traditional Dissolution of Marriage.  A valid domestic partnership is created when parties have met the requirements established by Family Code section 297, and have filed a Declaration of Domestic Partnership (Form – NP/SF DP-1) with the Secretary of State.

As in a marriage, in the event that a domestic partnership relationship has irrevocably ended, the parties have the task of dividing their community life.  Assets that were acquired while joined in a domestic partnership must be divided, and if the partnership has children as a product of the relationship, sensitive choices regarding child custody, visitation and support must be made.

There are two ways to terminate a valid Domestic Partnership in California.  Either a Notice of Termination of Domestic Partnership must be filed with the California Secretary of State, or a judgment must be obtained from a California Superior Court.  This process is substantially similar to the way that marriages are dissolved.
